One. General provision
1.1 This procedure regulates the relations related to the organization of an auction to grant the right to possess and use a number to an individual, business entity or organization of Mongolia.
1.2 Number holders/owner and participants should be registered and an auction is organized through “9911.mn” website of “Quality Number” LLC.
1.3 Definition
- Organizer – is 9911.mn or “Quality number” LLC, auction organizer entity.
- Owner/Holder – is a legal entity interested in selling its number at auction.
- Participant – is user, who was registered as the auctioneer for the number interested in buying.
- Special Number - The most demanded phone number on the market. The organizer will assign a special number (9911 and 8811).
- Normal number - All mobile and landline numbers.
- Fee - The fee to be paid to participate in the auction
Two. Principles to be followed in the auction
2.1.1. The number to be auctioned must not be pledged. The owner/holder must have kept it in the name of his legal entity for at least one month.
2.1.2 The owner must enter the number 1 hour before the start of the auction.
2.1.3 The auction must be shown on 9911.mn website as open.
2.1.4 In case of one of participant is winning the auction, should purchase the number within 20 hours.
Three. Right and obligations of Auctioneer
3.1. Individuals, business entities, organizations and foreign citizen may participate in the auction by registering and paying the fee under the right to possess and use the numbers.
3.2. The Auctioneers shall have following rights:
3.2.1 to get acquainted with the number information for free;
3.2.2 to file the claim or/and complaints related to the auction to 9911.mn website.
3.3. The Auctioneers are obligated:
3.3.1 to apply to participate in the auction online and to pay the fee;
3.3.2 to observe the auction procedure;
3.3.3 to negotiate with number holder on assigning ownership right of number and payment procedure within 20 hours, in case of winning the auction.
3.5. It is prohibited to interrupt the auction in any form during the auction, including disrupting the sequence of bidding and attempting to influence others.
3.6 The initial price of the number to be auctioned must be less than the market price.
Four. Auction type and auctioning sequence
4.1. The auction will be conducted with website and mobile application:
4.2. The auction will be held in the following order/sequence:
4.2.1. to ensure the preparation for the auction;
4.2.2. to announce the auction;
4.2.3. electronic registration of auction holders and participants;
4.2.4. to conduct an auction;
4.2.5. to provide information to auction winners.
Tav. Prepare for the auction
5.1. 9911.mn is responsible for the preparation of the electronic auction and is responsible for the following provisions:
5.1.1. 9911.mn monitors the auction process.
5.1.2. 9911.mn appoints the operator, who is ready to provide regular information via 7766-9911 during the auction.
5.2. The cost of preparation for the auction shall be borne by the proceeds of the auction.
Six. Announcing the auction
6.1. Auction announcements are regularly posted on the website:
6.2. The following information must be included in the announcement specified in 6.1 of this procedure:
6.2.1 decision of an authorized person regarding on to issue a number through auction;
6.2.2 initial price of the auction;
6.2.3 fee amount and account number to pay the fee;
6.2.4 clause of the contract;
6.2.5 e-mail address and contact telephone number for the auction;
6.2.6 deadline for registration of auctioneers;
6.2.7 start and end date and time of the auction;
Seven. Registration of auctioneers and number owners/holders
7.1. Auctioneer will be eligible to participate in the auction by registering online and paying a fee before the auction begins.
7.2. Anyone wishing to participate in the auction must register their phone number, e-mail and name correctly.
7.3. If the registration information is incorrect or erroneous, the winner may be canceled due to mutual agreement with the owner.
7.4. The registration information of auctioneers and owners are confidential and it is prohibited to keep to disclose information to others.
7.5 Auctioneer and owners must pay a fee.
Eight. Conducting the auction
8.1. Disputes arising during the auction shall be reviewed and resolved by the Auction Working Group.
8.2. The representative of the Auction Working Group has the following rights and obligations:
8.2.1. to be fully responsible for conducting the auction;
8.2.2. shall have the right to extend the deadline for the auction.
8.2.3. to ensure that records of the auction process are accurate and complete.

8.2.3. The final winner is determined after an extended period of 60 seconds after the end of the auction time.
8.3. Full information on the auction process shall be stored.
8.4. The electronic auction shall be conducted on the day, time and minute of the auction in the following sequence:
8.4.1. 9911.mn will conduct e-auction using special auction software posted on the website;
8.4.2. A person or legal entity wishing to participate in the electronic auction should submit his / her/its request to the website in accordance with Article 7.2 of this Procedure within the period specified in the auction announcement;
8.4.3. Upon receipt of the request, the winner of auction shall be notified by confirming the login name and password at the special software for conducting the electronic auction;
8.4.5. The auctioneer should submit his / her proposal to the special software for conducting the auction and shall have the right to log in until the auction is terminated, to get acquainted with the proposals submitted by other auctioneers, and to ascend the price;
8.4.6. The e-auction starts at 19:00:00 on the scheduled day and stop at 21:00:00 on same day, and the time can be extended as auctioneers can ascend the price in the last 1 minute.
8.4.7. The auctioneer who submitted the highest proposal within the period specified in 8.4.6 of this Procedure shall be selected as the winner using special auction software and each auctioneer shall be notified;
8.4.8. A winner of the auction should pay the payment to the number holder/owner and assigning the ownership right of the number onto his/her name within 20 hours from the date of auction. If the owning right of the number onto his/her name is not changed by the deadline, the next winner may be nominated.
8.4.9. By stopping the e-auction within the period specified in Provision #8.4.6 of this Procedure, the time of each proposal submitted by auctioneers shall be recorded in hours, minutes and seconds and the information should be transparent.
8.4.10. The fee of the auction owner and auctioneer shall be the income of the auction organizer.
8.5. Relations not regulated under this procedure related to conducting an auction may be regulated in accordance with Article #197 of the Civil Code.
8.6. An auction shall be deemed not to have taken place if one auctioneer participated in the auction or did not submit proposal higher than the initial auction price.
8.7. If the initial price of the number involved in the auction is too high above the market price, the auction is considered as taken place.
Nine. Re-auctioning
9.1. The auction may be conducted again in the following cases:
9.1.1. an auction shall be deemed not to have taken place if only auctioneer participated in the auction or did not submit proposal higher than the initial auction price. Note: Provision #9.1.1 may be invalid if the initial price of the owner's number is higher than the market price.
9.1.2. the auction was not held or the condition for conducting the auction were not ensured;
9.1.3. a court decision has been determined that the auction is violating relevant law; and
9.1.4. other cases set forth in law.
9.2. 9911.mn makes the decision regarding on re-auctioning.
Ten. Assigning the ownership right of number to the auction winner
10.1. 9911.mn shall provide information to both parties to the auctioneer who submitted the highest proposal from all bidders and the owner of number.
10.2. 9911.mn is not responsible for any disputes related to payment or assigning ownership right of number related to the winner and number holder.
10.3. Within 20 hours of winning the auction, the number holder and auction winner must make the payment and assigning the ownership right of number. If it is delayed or postponed, should notify 9911.mn.
10.4. The records or/and protocol of the auction is archived in the database.
Eleven. Auction price and fee
11.1. The starting price or/and initial price of the auction shall be entered by the owner/holder of the number and the starting price must be less than the market price.
11.2. The amount of fee shall be determined by 9911.mn depending on the market price of the number.
Number is divided into two types: special numbers and ordinary numbers.
- Special number fee, auctioneer- 10,000 MNT, 5 USD
- Special number fee, holder - 20,000 MNT, 10 $
- Ordinary number fee, auctioneer- 5,000 MNT, $ 2
- Ordinary number fee, holder - 10,000 MNT, $ 5
11.3. The fee will be transferred in 9911.mn’s deposit account.
11.4. In case of auction is taken place, the fee should be 9911.mn’s revenue. If canceled or not taken place, the re-auction will be free of charge.
Twelve. Dispute settlement
12.1. Disputes arising during the auction shall be settled by 9911.mn.
12.2. Individual, business entities and organizations have the right to file their complaints related to the auction to court for final settlement in accordance with the laws of Mongolia.
